Energy consumers in the Free Market (ACL) are constantly seeking opportunities to reduce their energy costs and simultaneously view the power sector as an opportunity to decrease their carbon footprint through renewables. One available solution for consumers is to meet their needs through a self-production structure.
Self-generation emerged in Brazil from a legal perspective in the 1990s with Law# 9,074/1995, in a context involving hydro projects, where large electro-intensive consumers participated. In 2007, Law # 11,488/2007 created the concept of self-production with equivalence shares, which aims to equate the rights of consumers participating in a Special Purpose Vehicle (SPE in Portuguese) with those investing in a classic structure. Another available modality is self-generation under leasing asset procedure.
Consumers can avoid significant charges such as ESS (System Services Charge), CDE (Energy Development Account), Proinfa (Incentive Program for Alternative Sources of Electric Energy), Energy Reserve, and Capacity Reserve Charge, as well as receive a 50% discount on transmission and distribution costs with renewables (observing renewable discount transition laws).
